The Georgia Court of Appeals has issued a stay in the ongoing legal proceedings against former President Donald Trump according to CBS News.
This decision temporarily halts the 2020 election case as the court reviews a prior ruling regarding the eligibility of Fulton County District Attorney Fani Willis to lead the prosecution against Trump. The stay was granted following concerns about Willis' past personal relationship with Nathan Wade, a special prosecutor in the case.
This relationship, which both acknowledged, began after Wade's hiring in November 2021 and ended in the summer of 2023. Trump and eight co-defendants have challenged Willis' continuation, citing this relationship.
A three-judge panel of the appeals court is set to consider this issue in detail on October 4, as part of their August term, with a final decision due no later than March 14, 2025.
This timeline makes it increasingly unlikely that the trial could commence before the November elections, where Trump is slated to run against incumbent President Joe Biden.
Fulton County Superior Court Judge Scott McAfee had previously ruled to allow Willis to remain on the case, post Wade’s resignation. Although McAfee criticized Willis for "a tremendous lapse in judgment," he did not find sufficient grounds to disqualify her from the case. However, his decision carried a caution, noting a lingering "odor of mendacity" around the disqualification request.
