Texas Attorney General Paxton Impeached By Texas House, Suspended And Now Awaiting Senate Trial

On Saturday, the Texas House of Representatives voted to impeach Attorney General Ken Paxton by an overwhelming vote. Paxton is therefore immediately suspended from office as he awaits a trial in the Texas Senate. Reportedly Paxton himself was not at the session.

More than 81 percent of the members voted to impeach Paxton, on the 20 articles of impeachment filed by the House General Investigations Committee, during a hearing on the floor of the Texas House. The final vote was 121 ayes, 23 nays, two present not voting, and three abstentions. Objections to the proceedings were nearly exclusively about the process and not about whether Mr. Paxton was guilty or innocent of the allegations made against him.

Lasting nearly four hours, the debate centered mostly around the process that some members believed was rushed and did not provide due process. One supporter said that those Democrats who impeached Donald Trump spent more time investigating the matter before them, than members of the General Investigations Committee, who in Paxton’s case, laid out the facts they believe supported the matter. The vote now moves the case forward to a trial in the Texas Senate.

The matter now heads to the Texas Senate, where Paxton and his lawyers will have an opportunity to lay out his case. Reportedly Paxton has denied any wrongdoing, claiming the matter is politically motivated. Voting to impeach Paxton, does not establish his guilt or innocence at this point. The House action says there is enough question with evidence to send the matter to the state Senate.

However, it does impede his office from proceeding on cases that Paxton currently has against the Biden administration over border policies, and current research his office had been involved in regarding big Pharma and  other COVID – 19 related matters, such as “gain of function” studies.

On the Texas House floor, almost every member who spoke, discussed the solemn nature of the actions they were about to take.  Some of those comments were-

  • House General Investigations Committee Member David Spiller (R-Jacksboro) said on the House floor, “Today is a very grim and difficult day for this House and for the state of Texas,”
  • Representative John Smithee, (R-Amarillo) said on the floor of the House, “This process is indefensible,” “It concerns me a lot because today it could be General Paxton, tomorrow it could be you and the next day it could be me.”

In a statement by Paxton, which was tweeted shortly after the voted to impeach him by the Texas House was made, Paxton said-

“An ugly spectacle”… “it was a politically motivated sham from the beginning”

According to the Texas Constitution, the impeachment requires a two-thirds majority of the senators who are present to convict and permanently remove Paxton from his elected position of attorney general. This means that nine Republican senators would have to join with 12 Democrats to convict him. Republicans currently hold a 19-12 majority in the Texas Senate.

Many who know the conservative veracity of Paxton, are reasoning through the abruptness of this impeachment trial in the Texas House. Noting that, without excuse, Paxton has turned over many cans of worms, on behalf of Texas and rattled the cages of many who would like to silence him. According to one supporter in his home county, Paxton has “taken a lot of arrows” because of this. Some, literally want him in jail where he can be kept out of public office.

“One month ago as reported by @mirandadevine in the NY Post, Paxton announced his new investigation into whether Pfizer, Moderna and Johnson & Johnson misled Texans on the efficacy and safety of their vaccines and whether they manipulated clinical trial data. Paxton was also looking into whether the pharmaceutical giants engaged in gain-of-function research.”
