A New York judge has confirmed the conviction of Donald Trump for his involvement in a hush-money case, challenging the notion of presidential immunity.
The Hill reported that the case involved Trump's actions before the 2016 presidential election, where he was accused of making a $130,000 payment to Stormy Daniels to suppress information. This led to Trump's conviction on 34 counts of falsifying business records.
Judge Merchan’s decision comes in the wake of Trump's electoral victory, which had sparked discussions about the potential impact of his presidential status on ongoing legal challenges.
Trump's legal team argued for immunity, citing a Supreme Court decision that grants former presidents absolute immunity for acts within their constitutional powers and presumptive immunity for official actions. However, this case dealt with actions deemed personal and unrelated to official duties.
Judge Merchan emphasized that the evidence, including testimonies from Trump White House aides, social media posts made while in office, and his government ethics form, pertained strictly to unofficial conduct. Consequently, such evidence did not qualify for immunity protection.
“The evidence related to the preserved claims relate entirely to unofficial conduct and thus, receive no immunity protections; and as to the claims that were unpreserved, this Court finds in the alternative, that when considered on the merits, they too are denied because they relate entirely to unofficial conduct,” Judge Merchan explained in his ruling.
This defining ruling marks Trump’s conviction as the first criminal prosecution of a former U.S. president to reach trial, setting a significant legal precedent.
Responding to the verdict, Steven Cheung, Trump’s spokesperson, and the incoming White House communications director criticized the ruling as a violation of the Supreme Court’s decision on presidential immunity, labeling it part of the "Manhattan DA Witch Hunt".
The controversy surrounding the trial was further fueled by claims from Trump about alleged juror misconduct during the proceedings, adding to the tumultuous atmosphere of the case.
