DOJ Seeks Dismissal Of Charges Against Former Republican Congressman Jeff Fortenberry

 January 30, 2025

The Department of Justice has formally proposed the dismissal of charges against Jeff Fortenberry, a former Republican congressman.

This movement by the DOJ aims to eliminate the possibility of re-filing similar charges against Fortenberry, reflecting an ongoing trend under President Trump's administration to halt prosecutions against his allies according to The Hill.

On Wednesday, federal prosecutors took a significant step by requesting to dismiss with prejudice the legal case against Fortenberry, who previously represented Nebraska. This legal decision means that Fortenberry cannot be tried again on the same charges.

Fortenberry's difficulties began following allegations that he lied to FBI agents regarding his knowledge of illegal campaign contributions from a foreign billionaire. These charges led to a conviction by a California jury, which was a major factor in his decision to resign from Congress in 2022.

The illegal campaign contributions were reportedly made at a fundraiser in Los Angeles in 2016, resulting in the initial trial being held there. However, Fortenberry's lawyers argued that the venue for the trial was inappropriate.

Following these events, an appeals court overturned Fortenberry's initial conviction in 2023, citing that the trial should have been held in Nebraska or Washington, D.C., where the interviews with FBI agents took place.

Reopening and Dismissal of the Case

Despite the conviction being overturned, federal prosecutors reinitiated the case in Washington in May, preparing for a new trial. However, this recent decision from the DOJ to dismiss the case halts any further prosecution plans.

The federal appeals court’s decision was a turning point, questioning the choice of Los Angeles as the venue for the initial trial. This discrepancy played a crucial role in the DOJ’s decision to request a dismissal.

This action aligns with President Trump’s broader strategy of terminating criminal prosecutions against his political allies, reflecting similar instances including those linked to the Jan. 6 Capitol attack and the federal classified documents case.

In response to the DOJ's decision, former President Donald Trump celebrated the dismissal of Truth Social.

He stated, "The charges were baseless. That Scam is now over, so Jeff and his family can go back to having a great life together, and be a part of our Country’s future as we MAKE AMERICA GREAT AGAIN."

Trump further expressed his pleasure over the recent actions of the DOJ, saying, "I am very proud of our Department of Justice, something I have not been able to say for many years!” This statement marks a strong approval of the department’s current conduct under his political influence.

The dismissal not only marks a significant relief for Fortenberry and his family but also illustrates the shifting dynamics within the Department of Justice, particularly in how cases related to politicians are handled under political pressure.

Broader Impact of the DOJ’s Decision

This case sheds light on the complexities of legal battles involving politicians and the influence of presidential administrations on judicial proceedings.

The dismissal, with its implications of finality, serves as a precedent for how similar cases might be handled in the future, underlining the intersection of law and politics.

Legal experts and political analysts alike will likely watch closely how this dismissal influences other ongoing litigations and prosecutions, especially those involving political figures under the current administration.

For now, Fortenberry's legal battles appear to be over, allowing him and his supporters to focus on moving forward without the looming shadow of a courtroom battle. The case remains a significant example of the legal and political challenges that can intertwine when political careers and federal investigations intersect.
