On Wednesday, the Georgia Supreme Court reinstated the State’s “heartbeat bill”, after a left-wing Fulton County judge overturned it. Banning most abortions after six weeks, the measure is based on fetal heartbeat detection which is typically present by this time.
Fulton County Judge, Robert C. I. McBurney had previously struck down Georgia’s abortion ban, attempting to read the right to abortion, into the state’s constitution, much in the same way Roe v. Wade and Planned Parenthood v. Casey were, according to Breitbart News.
Made after the overturn of Roe and Casey in Dobbs v. Jackson Women’s Health Organization, McBurney’s opinion, made a blatant appeal to substantive due process (the invention of constitutional rights by the judiciary) saying-
“This ruling is merely a reinforcement of what ought to be for everyone the uncontroversial notion that, if the judicial branch has declared a constitutional right, legislatures exceed their authority, improperly expand their role, and fundamentally alter the balance struck by the separation of powers when they enact laws they know to be plainly and facially unconstitutional.”

In countering McBurney’s blatant appeal to substantive due process, the state of Georgia’s Supreme Court, on November 23, 2022, issued a one-page reversal of the Judge’s opinion. Also, failing to unseat pro-life Georgia Gov. Brian Kemp (R), Democrats are going all out in the December 6th runoff election, between pro-abortion Sen. Raphael Warnock (D-GA) and pro-life Republican candidate Herschel Walker.
As a result of their performance, Republicans continue to reassess how they handled issues prior to Election Day.
As such, many believe it was the candidates’ fear of addressing social issues, focusing far too much on the economy and inflation, that contributed to their narrow House majority, and loss in the Senate. An election is still taking place in Georgia scheduled for early next month.
This election will determine whether Democrats have an outright majority, or a 50–50 split, requiring Vice President Harris to break any ties. It has been a tight race, and the situation continues to build, as the focus on the diverse backgrounds/platforms of Warnock (a true liberal-leftist Democrat) and Walker (a true conservative, pro-America first, Republican) are front and center before Georgia’s voters.
Republicans from across the nation, have weighed in on the importance of Herschel’s campaign, supporting him at every turn. Well liked as a man of principle, Walker has avoided name calling, and any kind of personal smear campaign against Warnock, but has stuck to the issues before the people of Georgia. His down home, common sense approach to getting things done, is sure to be the hallmark of his tenure in office, if he comes out the winner of this race. In Walker, Georgia has a truly courageous patriot, someone literally willing to put their money where their mouth is, without hesitation. Truly this kind of character is a rare find, either side of the isle – in today’s political arena.
