Bill Pulte, director of the Federal Housing Finance Agency, fired off two fresh criminal referrals targeting New York Attorney General Letitia James on Wednesday, this time alleging suspected homeowners' insurance fraud.
The referrals landed at two separate U.S. Attorney offices: one in the Northern District of Illinois and another in the Southern District of Florida. A DOJ spokesperson confirmed the filings were received.
According to CNN, the new referrals allege that James may have submitted homeowners' insurance applications involving suspected fraud. Both referrals cite posts on X by Mike Davis, a longtime Trump legal adviser, as part of their basis.
This isn't the first time the Trump administration has pursued James through the Justice Department. She was indicted in October 2025 on one count of making false statements to a financial institution and one count of bank fraud. James pleaded not guilty to both charges.
That case, brought in the Eastern District of Virginia, was ultimately dismissed. Not on the merits. A judge found that the appointment of interim U.S. Attorney Lindsey Halligan in Alexandria, Virginia, was invalid, which meant the charges weren't brought by a valid prosecutor. The substance of the allegations was never tested in court.
That distinction matters. The dismissal handed James and her allies a talking point, but it resolved nothing about the underlying conduct. By routing these new referrals to Illinois and Florida, the administration sidesteps the procedural defect that sank the Virginia case entirely. Different jurisdictions, different prosecutors, a clean procedural slate.
Abbe Lowell, the attorney representing James, responded with a statement that leaned heavily on the political persecution narrative. He told CNN:
"Frustrated by repeated failures, where judges and grand juries have rejected their attempts to charge Attorney General James, Trump and his political enablers keep abusing their power to pursue a vendetta against her by trying to rename, refile, and repeat baseless allegations."
He continued:
"They continue this improper revenge campaign instead of helping bring down the rising cost of living in this country. These desperate tactics will fail — just as every previous attempt has failed — and exposes an Administration that has abandoned its responsibility to the American people in favor of petty political payback."
It's a polished response. It's also a familiar one. When Democrats face legal scrutiny from a Republican administration, the playbook writes itself: call it political, invoke "the people," and pivot to cost of living. The statement never addresses the actual substance of the insurance fraud allegations. Not a single sentence engages with what James is accused of doing. Instead, it treats the existence of the referrals as self-evidently illegitimate.
There is a particular irony in James framing herself as a victim of politicized prosecution. This is the same attorney general who ran for office on a platform of targeting Donald Trump personally. She campaigned on it. She built her political brand around it. She pursued civil and legal action against Trump with the kind of zeal that looked less like dispassionate law enforcement and more like a political project.
That doesn't mean she's guilty of insurance fraud. It does mean the "weaponization" argument rings hollow when it comes from someone who weaponized her own office with enthusiasm. You don't get to pioneer the tactic and then cry foul when the machinery turns in your direction.
The left spent years arguing that no one is above the law, that investigations should go wherever the evidence leads, and that complaints about political motivation are just attempts to dodge accountability. Those were the rules they set. Now those rules apply to one of their own, and suddenly the entire framework is an abuse of power.
Criminal referrals are not indictments. They are requests for prosecutors to investigate. The U.S. Attorneys in Illinois and Florida will now decide independently whether the allegations warrant further action, a grand jury, or nothing at all. The process plays out from here on its own terms.
But the strategic choice to file in two separate jurisdictions signals that the administration learned from the Virginia dismissal. The procedural error that killed the first case has been removed from the equation. If there is substance behind the insurance fraud allegations, these referrals give prosecutors a clean path to examine it.
Lowell can call it desperate. James can call it revenge. But the DOJ confirmed receipt, the referrals are real, and the question now isn't whether the administration is serious. It's whether the evidence holds up.
Letitia James built a career on the principle that powerful people must answer for their conduct. She may now have to live by it.
