Trump DOJ holding back on hitting Charlie Kirk shooter with federal charges

Tyler Robinson, the suspect in the tragic killing of conservative activist Charlie Kirk, remains uncharged by federal authorities despite a mountain of evidence.

The Daily Caller reported that more than a month after Robinson’s arrest, the Department of Justice under the Trump administration is still weighing federal charges while Utah aggressively pursues state prosecution for aggravated murder, with the death penalty in play.

On September 10, 2025, tragedy struck at Utah Valley University in Orem, Utah, during a Turning Point USA event where Charlie Kirk, a prominent conservative voice, was fatally shot.

Tyler Robinson, a 22-year-old suspect, allegedly carried out the attack, leaving behind chilling evidence like cartridges engraved with taunts such as “hey fascist!” according to Utah authorities.

Just a day later, on September 11, 2025, Robinson turned himself in, perhaps realizing the weight of his actions couldn’t be outrun.

Soon after, Utah County Attorney Jeffrey Gray charged him with a litany of serious offenses, including aggravated murder and witness tampering, the latter tied to his apparent attempts to evade capture.

Utah’s Hardline Stance on Justice

Utah isn’t pulling punches—Gray’s office is pushing for the death penalty, signaling a no-nonsense approach to a crime that shook the conservative community to its core.

Adding a layer of intrigue, Robinson reportedly texted a personal contact claiming he targeted Kirk because some hatred “can’t be negotiated out,” a statement that raises questions about motive and ideology.

Meanwhile, the FBI jumped into action immediately after the incident, collecting evidence at the university and expanding their probe to online chat rooms and local activist groups possibly linked to Robinson.

Yet, despite the FBI’s swift moves, the Department of Justice has remained silent on federal charges, with Deputy Attorney General Todd Blanche noting they’re still sifting through evidence to pinpoint Robinson’s motivations.

“But that goes after going through all the evidence and trying to understand what this man’s motivation was in doing what he did,” Blanche said in a Fox News interview in September 2025.

While Blanche’s caution might sound reasonable, it’s hard not to wonder if the DOJ is dragging its feet when a conservative icon’s life has been snuffed out—would the same delay apply if the victim leaned left?

State vs. Federal Jurisdiction Debate

Legal experts suggest the DOJ often takes its time when state charges are already in motion, as there’s less urgency to duplicate efforts, especially in a state like Utah that’s unlikely to go soft on punishment.

“I think we need to know more factual information, but there is probably a federal hook for the Justice Department to … take jurisdiction,” said Zack Smith, a senior legal fellow at the Heritage Foundation, to the Daily Caller News Foundation. Let’s hope that “hook” doesn’t turn into a fishing expedition while justice waits.

As Robinson’s legal team wades through what Utah officials call “voluminous” evidence, court delays have pushed his next hearing to January 2026, leaving many wondering if the system prioritizes process over people.

Federal assistance could be a game-changer for Utah’s case, with shared evidence potentially strengthening the prosecution.

Yet, with the DOJ’s hesitation and progressive agendas often muddying the waters of justice, conservatives are right to demand clarity and accountability in this heartbreaking case.
