President Biden Sets Judicial Appointment Record In A Single Term

 December 22, 2024

President Joe Biden has recently achieved a significant landmark by confirming his 235th federal judicial nominee, surpassing records set since the Carter administration.

Today marks a historic achievement as President Biden confirmed his 235th judge, setting a new record for judicial appointments in a single term and surpassing President-elect Donald Trump's record.

Ever since his tenure as the leader of the Senate Judiciary Committee, President Biden has been deeply committed to shaping the federal judiciary.

The nominees encompass a diverse range of judicial positions, including one Supreme Court justice, 45 judges on the courts of appeals, 187 district court judges, and two judges to the United States Court of International Trade.

Highlighting Cooperation Across the Aisle

The President’s efforts have been marked by collaboration with Senators from both major political parties to address the vacancies efficiently. This bipartisan approach has been crucial given the challenges of operating within the longest 50-50 Senate in U.S. history.

President Biden once pledged during his campaign to focus on nominating judges from underrepresented professional backgrounds.

His administration has followed through by appointing several professionals who represent a significant departure from traditional judicial pathways.

Among his notable appointments is the first former public defender to the Supreme Court. Furthermore, his administration has appointed more than 45 public defenders, over 25 civil rights lawyers, and at least 10 advocates for workers’ rights across various levels of the judiciary.

Judicial nominees under President Biden also include individuals from private legal practices, prosecutor’s offices, and other specialized legal fields, such as immigration and municipal law. Some nominees have also brought valuable experience from military service, in both legal and non-legal capacities.

This approach not only diversifies the professional backgrounds of the federal judges but also enhances the representation of different communities within the judiciary. The President's commitment to diversity has seen the appointment of the first Black woman to the Supreme Court, a historic accomplishment.

The demographic diversity continues across Biden’s judicial appointments, setting records with a high number of judges who are women, Black, Latino, Asian American and Native Hawaiian or Pacific Islander (AANHPI), Native American, Muslim-American, and members of the LGBTQ community.

These diverse appointments have not only broken old records but have also set new ones. For example, more Black women have been appointed to circuit courts during President Biden’s tenure than in all previous administrations combined.

The administration emphasizes that these "highly qualified men and women—all committed to the rule of law and the Constitution—will serve the federal Judiciary for decades to come." Their appointments are seen as a crucial counterbalance to prevent overreach and help protect the constitutional framework of the United States.

The President has expressed pride in his record and gratitude towards the Senate for its partnership in achieving this milestone. "No President has done more to bring professional and experiential diversity to the federal bench than President Biden," asserts his administration.

Securing Confidence in Federal Judiciary Through Diversity

"Importantly, President Biden has followed through on one of his earliest campaign promises—to put forward highly qualified judges from underrepresented professional backgrounds and to instill confidence in the Judiciary by ensuring that federal judges reflect the nation as a whole," notes the administration.

This achievement is seen not just as a fulfillment of a numerical record but as a foundational step towards reinforcing the integrity and responsiveness of the judiciary to the needs of a diverse America.

Lastly, the long-term impacts of these appointments will resonate beyond immediate legal landscapes, helping shape a judiciary that is more representative, balanced, and aligned with the values of a broad spectrum of American society.

"Judges are also crucial to protecting against overreach and unconstitutional action by the Executive and Legislative Branches," the administration highlights, underscoring the critical role of the judiciary in maintaining checks and balances within the government structure.

As President Biden continues to shape his legacy through these appointments, the judicial landscape of America is set to evolve in a manner that mirrors its growing diversity and complex legal needs. His administration's efforts are a testament to a strategic and inclusive approach to judicial appointments.
