Supreme Court Chief Justice Rejects Calls From Democrats To Investigate Fellow Justices

 June 20, 2024

House Representatives are urging Chief Justice John Roberts to address alleged ethical concerns involving Justices Clarence Thomas and Samuel Alito.

The Hill reported that requests to Chief Justice John Roberts from House Democrats, specifically Rep. Jamie Raskin and Rep. Alexandria Ocasio-Cortez, concerning Justices Clarence Thomas and Samuel Alito were smacked down as Roberts recognized the blatant partisan nature of the allegations.

The crux of the issue revolves around undisclosed expensive trips and questionable gifts received by Justice Thomas and controversial flags linked to the "Stop the Steal" movement displayed at Justice Alito’s private homes.

The questionable gifts issue has already been heavily investigated with recent disclosure reports from all justices showing that neither Thomas nor Alito improperly accepted gifts. However, Democrats are looking to undermine the Supreme Court's legitimacy so they are pressing the issue.

So far, the response from Chief Justice Roberts has been to decline a meeting with the concerned Democrats to discuss these allegations. Roberts is politically centrist and his refusal to meet with Democrats is further proof that this is nothing but a partisan witchhunt.

Baseless Accusations Against Conservative Justices

The House Judiciary Democrats pointed specifically to three trips sponsored by GOP mega-donor Harlan Crow which Justice Thomas failed to report.

These undisclosed trips were internally investigated and nothing was found to be improper but Raskin and AOC, two of the more radical Democrats in Congress, are still trying to generate a controversy where none should exist.

In response to allegations against Justice Alito, the lawmakers emphasized the need for Alito to recuse himself from certain cases where his impartiality might be compromised. This need stems from the controversial flags representing a political stance that was reportedly managed by Alito’s wife at their residences. These displays call into question the neutrality required of a Supreme Court Justice.

Despite claims of impartiality, the refusal by both Justices Thomas and Alito to recuse themselves from numerous cases surrounding political controversies like the January 6 events has intensified scrutiny. Justice Thomas did recuse himself from a case involving John Eastman, a figure linked to the January 6 events.

This selective recusal and persistent participation in related cases has caused Congress members and the public alike to question the existing checks on judicial conduct within the Supreme Court.

The contrast in the court’s action, including its comprehensive investigation into the leaked Dobbs draft opinion, versus its handling of its members' potential ethical breaches has been stark.

Statements from Raskin and Ocasio-Cortez emphasize a worrying trend in the judiciary's self-regulation. "This anomalous way of keeping track of ethical transgressions at the Court raises the question of whether the Supreme Court is unable, or perhaps just unwilling, to investigate and police its conduct..." they stated. This concern underscores the potential conflict of interest and the lack of rigorous ethical oversight at the highest level of judicial power.

The refusal of the justices to step down from cases with clear conflicts of interest has been described as "increasingly untenable" by oversight lawmakers. The representatives argue, "Justice Alito’s and Justice Thomas’s transparently partisan ideological activity calls into question their impartiality... enforcement of the Court’s Code of Conduct, as well as constitutional and statutory guarantees, cannot rest on Justice’s introspection and subjective evaluation of his conduct."

Journalists and Committees Rally for Transparency

This ongoing ethics crisis within the Supreme Court has attracted significant attention from journalists and congressional committees alike, all pointing towards a need for greater transparency and enforcement of ethical standards.

"We know that the Supreme Court is capable of conducting a comprehensive factual investigation," cited by Reps. Raskin and Ocasio-Cortez, further call into question the current enforcement mechanisms in place for monitoring the ethical conduct of justices.

The scrutiny of Justices Clarence Thomas and Samuel Alito’s actions by House Democrats, led by Rep. Jamie Raskin and Rep. Alexandria Ocasio-Cortez, has highlighted a broader issue of transparency and ethical conduct at the Supreme Court. There is a pressing need for a more robust system to ensure judicial impartiality and uphold the integrity of the judiciary, influencing how future ethical dilemmas are managed within the highest courts.
